Terms and Conditions for MXGRADE.COM
Effective Date: May 1st, 2025

These Terms and Conditions ("Conditions") govern all purchases made via the MXGRADE.COM e-store ("e-Store"), operated by KSHS EUROPE OÜ ("Seller"). By placing an order, the customer ("Customer") agrees to be bound by these Conditions.

  1. GENERAL TERMS

1.1 These Conditions apply to all purchases made in the e-Store and form the basis of the Sales Contract between the Customer and the Seller.

1.2 By confirming an order, the Customer acknowledges having read, understood, and agreed to these Conditions.

  1. PURCHASING AND ORDER PROCESS

2.1 Goods available for purchase will be marked with an "Add to Cart" button. Prices and availability may change without prior notice. Orders placed before a price change will be fulfilled at the price valid at the time of the order. All prices are in Euros, and payment is accepted only in Euros.

2.2 The Seller reserves the right to cancel any order if:

  • The Goods are out of stock or on special order.

  • A pricing or technical error has occurred.

2.3 Order Placement:

  • Customers can modify their cart, choose a delivery option, input required contact details, select a payment method, and finalize the order.

  • The Sales Contract is deemed concluded upon successful payment and order confirmation sent via email.

2.4 Payment Methods:

  • Credit Card (VISA/MasterCard)

  • PayPal

  • Direct Bank Transfer:

  • Upon payment, an invoice and order confirmation will be sent to the Customer.

  1. DELIVERY

3.1 Delivery is made to the address provided during checkout.

  • Northern & Eastern Europe: 5–10 working days.

  • Other regions: Timeframe to be confirmed via email.

  • Non-stock items: Estimated delivery 2–6 months, depending on supplier availability.

3.2 The Seller is not liable for delays due to incorrect Customer data.

3.3 Goods are handed over with a delivery bill. If packaging is damaged, this must be noted on the delivery bill and reported to info@mxgrade.com.

3.4 If the Customer fails to accept delivery within 14 days of the scheduled date, the Seller may cancel the contract and deduct storage or handling costs from any refund due.

  1. RIGHT OF WITHDRAWAL

4.1 Customers may withdraw from the Sales Contract within 14 days of receiving the Goods, by notifying info@mxgrade.com.

4.2 The right of withdrawal does not apply to:

  • Custom-made Goods

  • Goods marked as "On Order"

  • Delivered services such as transportation

4.3 Returned Goods must be unused, undamaged, and in original packaging. The Seller may deduct the value of any missing items or damages.

4.4 A handling fee of up to €500 may be deducted from the refund where applicable.

4.5 Refunds will be made within 14 days after return of the Goods, to the original payment method.

  1. ORDER CANCELLATION

5.1 Orders may be cancelled within 12 hours of payment without a fee.

5.2 Cancellations after 12 hours are subject to a €50 handling fee.

5.3 To cancel, email info@mxgrade.com with your order number.

  1. DATA PROTECTION

6.1 The Seller processes personal data in accordance with applicable EU data protection laws.

6.2 Data is used solely for order processing and service improvement. For marketing use, the Customer's explicit consent is required.

6.3 The Customer may withdraw consent for marketing at any time by emailing info@mxgrade.com.

6.4 Payment and Hosting Providers as Data Processors

Personal data necessary for processing payments is shared with authorised payment service providers. MXGRADE.COM uses Shopify Payments, a service provided by Shopify Inc. and its local affiliates, for processing customer payments. Shopify Payments may share necessary data with financial institutions and payment networks as required to complete transactions.

Additionally, MXGRADE.COM is hosted on Shopify Inc., which provides the online e-commerce platform. Shopify acts as a data processor under the GDPR, while KSHS EUROPE OÜ remains the data controller. Shopify stores customer data on secure servers protected by firewalls. For more details, please refer to Shopify’s Privacy Policy: https://www.shopify.com/legal/privacy.

  1. COMPLAINTS AND WARRANTY

7.1 Complaints regarding defective Goods must be submitted within 2 years of delivery and no later than 2 months after the defect is discovered.

7.2 Remedies include repair, replacement, or refund.

7.3 The Seller is not liable for damage due to misuse or normal wear and tear.

7.4 Warranty conditions, if applicable, will be included with the Goods or provided electronically.

7.5 Purchase documents must be retained by the Customer.

7.6 Complaints must be submitted to info@mxgrade.com with details and images.

7.7 If needed, Goods may be sent to diagnostics or expert review.

7.8 Defects will be addressed in accordance with MXGRADE.COM's Complaint Policy.

  1. DISPUTE RESOLUTION

8.1 Disputes shall be resolved under Estonian law.

8.2 If unresolved, Customers may contact the Consumer Protection and Technical Regulatory Authority at info@ttja.ee or file through the EU ODR platform at http://ec.europa.eu/consumers/odr/.

  1. OTHER TERMS

9.1 Product images are for illustrative purposes only.

9.2 Product availability and prices are subject to change. Obvious pricing errors (e.g., EUR 500 product listed at EUR 50) entitle the Seller to cancel the transaction.

9.3 Product information is updated regularly. For confirmation, contact info@mxgrade.com.

9.4 Force majeure: The Seller is not liable for delays or non-performance caused by events beyond its control.

  1. VALIDITY

These Terms and Conditions are valid from May 1st, 2025 and apply to all transactions concluded thereafter on MXGRADE.COM.
